Acceptable Use Policy (AUP)

Thareja Technologies Inc. ("Thareja," "we," "us," or "our") provides cloud-based workforce management, AI assistant, chatbot builder, and video creation services through Thareja Work (app.thareja.ai), AI Assistant (chat.thareja.ai), Magic Agent (magicagent.thareja.ai), and Magic Reel (magicreel.thareja.ai). This Acceptable Use Policy ("AUP") governs your access to and use of all Thareja products, services, and platforms. By using any Thareja service, you agree to comply with this policy.

Violation of this AUP may result in immediate suspension or termination of your account, forfeiture of prepaid fees, and referral to law enforcement where applicable.

1. General Prohibited Conduct

You may not use any Thareja service to:

  • Violate any applicable local, state, national, or international law or regulation.

  • Infringe upon the intellectual property, privacy, or other rights of any third party.

  • Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

  • Engage in any activity that disrupts, degrades, or interferes with the functionality, security, or integrity of our services or infrastructure.

  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.

  • Collect, harvest, or store personal data of other users without their explicit consent.

2. System Abuse

You may not:

  • Attempt to gain unauthorized access to any Thareja system, network, or account.

  • Probe, scan, or test the vulnerability of any Thareja system or network without written authorization.

  • Interfere with or disrupt servers, networks, or services connected to Thareja platforms.

  • Use automated tools, bots, or scripts to access or interact with our services in a manner that exceeds normal human usage, unless explicitly permitted by an active API agreement.

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any Thareja software or service.

3. Spam, Phishing, and Fraudulent Activity

You may not use any Thareja service to:

  • Send unsolicited bulk messages, advertisements, or promotions (spam).

  • Engage in phishing, social engineering, or any scheme designed to fraudulently obtain credentials, personal information, or financial data.

  • Create fake accounts, fraudulent employer profiles, or fictitious employee records.

  • Manipulate time tracking data, attendance records, or productivity metrics for fraudulent purposes through Thareja Work.

  • Submit false or misleading information in connection with billing, payments, or contractor onboarding.

4. AI Content Generation Rules

The following rules apply to all AI-powered features across AI Assistant, Magic Agent, and Magic Reel:

4.1 You may not use any Thareja AI feature to generate, distribute, or facilitate:

  • Content that is illegal under any applicable jurisdiction.

  • Child sexual abuse material (CSAM) or any sexual content involving minors.

  • Deepfakes or synthetic media intended to deceive, defraud, or impersonate real individuals without their explicit consent.

  • Malware, ransomware, exploit code, or any software designed to damage, disrupt, or gain unauthorized access to systems.

  • Instructions or guidance for the creation of weapons, explosives, controlled substances, or other dangerous materials.

  • Content intended to harass, threaten, bully, stalk, or intimidate any individual or group.

  • Disinformation or deliberately misleading content designed to manipulate public opinion or interfere with democratic processes.

  • Content that promotes or incites violence, terrorism, or self-harm.

4.2 You are solely responsible for reviewing, verifying, and assuming liability for all AI-generated content before publishing, distributing, or relying on it.

5. AI Assistant Rules (chat.thareja.ai)

In addition to the general AI content rules above, users of AI Assistant may not:

  • Engage in prompt injection attacks or adversarial techniques designed to bypass the safety filters or operational boundaries of any third-party AI model accessible through the platform.

  • Attempt to extract, reconstruct, or reverse-engineer the training data, model weights, or proprietary methods of any AI model.

  • Use outputs obtained through AI Assistant to train, fine-tune, or develop competing AI models or services, unless expressly permitted by the applicable third-party model provider's terms of service.

  • Share, resell, or redistribute API access or model outputs in a manner that violates the terms of the underlying model providers.

  • Misrepresent AI-generated outputs as human-created work in contexts where such disclosure is legally or ethically required.

6. Chatbot Deployment Rules (magicagent.thareja.ai)

Users who build and deploy chatbots through Magic Agent must comply with the following:

6.1 Disclosure and Transparency. All chatbots must clearly disclose their AI nature to end-users at the start of each conversation. Chatbots must not be designed to deceive end-users into believing they are communicating with a human.

6.2 Identity and Impersonation. Chatbots must not impersonate real individuals, companies, government agencies, or other entities without verified written authorization from the entity being represented.

6.3 Minors. Chatbots must not knowingly collect, store, or process personal information from individuals under the age of 13 (or the applicable age of digital consent in the relevant jurisdiction). Operators deploying chatbots accessible to minors must implement appropriate age-gating measures and comply with COPPA and equivalent regulations.

6.4 Spam and Phishing. Chatbots must not be used to send unsolicited messages, conduct phishing campaigns, or engage in social engineering attacks.

6.5 SMS and Telephony Compliance. Chatbots deployed via SMS, voice, or telephony channels must comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable telecommunications regulations. This includes obtaining proper prior express consent before initiating automated messages or calls.

6.6 Operator Responsibility. The chatbot operator is solely responsible for the accuracy, legality, and appropriateness of the information their chatbot provides to end-users, and for ensuring compliance with all applicable laws in the jurisdictions where the chatbot is deployed.

6.7 Operator Privacy Policy. Any website, application, or platform on which a Magic Agent chatbot is deployed must maintain a publicly accessible privacy policy that, at a minimum: (a) discloses that an AI-powered chatbot is in use; (b) identifies the types of personal data the chatbot may collect from end-users (such as names, email addresses, phone numbers, and conversation content); (c) explains how that data will be used, stored, and shared; and (d) provides end-users with a way to exercise their data rights under applicable law. It is the chatbot operator's sole responsibility to create, maintain, and ensure the accuracy of their privacy policy. Thareja does not draft, review, or approve operator privacy policies.

7. Video Content Rules (magicreel.thareja.ai)

Users of Magic Reel must comply with the following:

7.1 Content Rights. You must have the legal right, license, or authorization to use all photos, images, listing data, and other materials uploaded to Magic Reel. You may not upload copyrighted content belonging to third parties without proper authorization.

7.2 Accurate Property Representation. AI-enhanced photos and generated videos must not create materially misleading representations of property conditions, features, or surroundings. You are responsible for ensuring that listing information presented in videos is accurate and current.

7.3 Fair Housing Compliance. All video content must comply with the Fair Housing Act and equivalent state and local fair housing laws. Videos must not include language, imagery, or targeting that discriminates based on race, color, national origin, religion, sex, familial status, disability, or any other protected class.

7.4 Listing Data. When importing data from third-party listing services (including Zillow, Realtor.com, and MLS systems), you are responsible for complying with the terms of service and data use policies of those platforms.

8. Copyright and Intellectual Property

You may not use any Thareja service to:

  • Upload, distribute, or generate content that infringes upon the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party.

  • Remove, alter, or obscure any copyright notices, watermarks, or proprietary legends from content accessed through our services.

  • Use Thareja services to facilitate the unauthorized reproduction or distribution of copyrighted works.

9. API Abuse and Rate Limit Circumvention

9.1 You may not circumvent, bypass, or attempt to exceed any rate limits, usage quotas, token allowances, message caps, or video credit limits imposed by your subscription plan or by our systems.

9.2 You may not use multiple accounts, automated scripts, proxy networks, or other techniques to artificially inflate usage, evade rate limiting, or obtain service beyond what your plan entitles you to.

9.3 You may not resell, sublicense, or share API credentials, access tokens, or account access with unauthorized third parties.

9.4 Thareja reserves the right to throttle, suspend, or terminate access for any account exhibiting patterns of abuse, excessive automated usage, or rate limit circumvention.

10. Enforcement

10.1 Thareja reserves the right, but has no obligation, to monitor use of its services for compliance with this AUP.

10.2 Upon discovering a violation, Thareja may, at its sole discretion and without prior notice:

  • Issue a warning to the offending user.

  • Temporarily suspend access to any or all Thareja services.

  • Permanently terminate the user's account.

  • Remove or disable access to offending content.

  • Report the activity to appropriate law enforcement authorities.

10.3 Users whose accounts are terminated for AUP violations are not entitled to any refund of prepaid fees.

10.4 Thareja reserves the right to cooperate with law enforcement authorities and comply with court orders requesting or directing the disclosure of the identity or other information of anyone posting, publishing, or otherwise making available any materials that violate this AUP.

11. Changes to This Policy

Thareja reserves the right to modify this Acceptable Use Policy at any time. Material changes will be communicated via email or through a notice on our platforms. Continued use of any Thareja service after the effective date of a modification constitutes acceptance of the updated policy.
